5 CAR § 21-101 – Purpose and interpretation

(a) The purpose of this part is to provide safeguards necessary to protect the health and safety of the citizens of Arkansas by establishing criteria for the use of breath alcohol ignition interlock devices.
(b)
1. (1) The impact of this part is directed toward the:
  1. (A) Manufacturer;
  2. (B) Service provider;
  3. (C) User of breath alcohol ignition interlock devices; and
  4. (D) Department of Health.
2. (2) Contents will, of necessity, describe interactions with the:
  1. (A) Courts; and
  2. (B) Office of Driver Services of the Department of Finance and Administration.
(c)
1. (1) This part shall be interpreted so as to favor the safety of the public.
2. (2) In the absence of a rule specifically addressing a particular matter, there shall be applied reasonable, just, and equitable procedures and substantive decisions which are predictable from the spirit and intent of:
  1. (A) The legislative enactment; and
  2. (B) This part.
