As used in this part the following definitions apply:

1. (1) “Arkansas State Police” means the Division of Arkansas State Police;
2. (2) “Blue lens cap” means any cap or cover which may be used with an emergency light to make the light appear blue;

3. (3) “Blue light” means an operable blue light which:

   1. (A) Is designed for use by an emergency vehicle or is similar in appearance to a blue light designed for use by an emergency vehicle; and

   2. (B) Can be operated by use of:

      1. (i) The vehicle’s battery;
      2. (ii) The vehicle’s electrical system; or
      3. (iii) A dry cell battery;
4. (4) “Constable” means a person duly elected or appointed to the office of constable, during the term of office of said person;
5. (5) “County coroner” means a person duly elected or appointed to the office of county coroner, during the term of office of said person;

6. (6) “Law enforcement officer” means a person who:

   1. (A) Has met the standards and qualifications as established by the Arkansas Commission on Law Enforcement Standards and Training; and
   2. (B) Is currently employed as a law enforcement officer by a municipal, county, state, or federal law enforcement agency, or who is so constitutionally authorized;

   1. (A) “Official law enforcement insignia” means those items relating to the performance of a person’s duty as a law enforcement officer when the items are formally sanctioned by the law enforcement agency employing the person.

   2. (B) This specifically includes any item which contains the notation of:

      1. (i) “Police”;
      2. (ii) “Sheriff”; or
      3. (iii) Any wording or lettering that would lead a reasonable person to conclude that the holder thereof was a law enforcement officer; and
8. (8) “Sheriff” means a person duly elected or appointed to the office of sheriff, during the term of office of said person.
