(a) Conformity with laws. Eligible service facilities shall comply with laws concerning:

1. (1) The provisions of public accommodations without regard to:

   1. (A) Race;
   2. (B) Religion;
   3. (C) Color;
   4. (D) Age;
   5. (E) Sex; or
   6. (F) National origin; and
2. (2) Laws concerning licensing and approval of service facilities.

(b) Types of services permitted.

1. (1) The types of services permitted shall be limited to:

   1. (A) Gas;
   2. (B) Food;
   3. (C) Lodging; and
   4. (D) Camping.

2. (2) To qualify for display on a general service sign:

   1. (A)

(i) “Gas” means retail businesses selling gasoline for motor vehicle use.

1. (ii) It is not intended to guide traffic to retailers selling fuel for industrial, agricultural, marine, aviation, or racing purposes.

   1. (iii) Eligibility requirements shall include:

(b) (b) Continuous operation at least sixteen (16) hours per day, seven (7) days a week; and

1. (c) (c) Modern sanitary facilities and drinking water located within two hundred feet (200’) of the fuel pumps;

   1. (B)

      1. (i) “Food” means retail businesses selling fully prepared and ready to eat meals intended for immediate consumption.
      2. (ii) It does not include grocery stores, catering services, or food retailers selling food intended to be cooked and consumed later at another location.
      3. (iii) It also does not include coffee shops, pastry shops, taverns, night clubs, or concessionaires that do not offer meals or only offer meals as an accessory use.
      4. (iv) Eligibility requirements shall include:

(b) (b) Continuous operation to serve meals beginning no later than 11:00 a.m. and closing no earlier than 7:00 p.m. at least six (6) days per week; and

1. (c) (c) Modern sanitary facilities and drinking water;

   1. (C)

      1. (i) “Lodging” means conventional motels/hotels or bed and breakfasts at which travelers can stay a single night.
      2. (ii) Apartment complexes, condominiums, time shares, rental houses, mobile home parks, or boarding houses are not included.
      3. (iii) “Extended stay” businesses will only be considered if they also rent rooms in one-night increments and do not require deposits or payment for multiple nights when only renting a room for one (1) night.
      4. (iv) Eligibility requirements shall include:

(b) (b) Adequate sleeping accommodations; and

1. (c) (c) Availability seven (7) days per week; and

   1. (D)

      1. (i) “Camping” means the overnight stay by travelers that provide their own temporary shelters such as tents, trailers, recreational vehicles, or motor homes.
      2. (ii) It does not include mobile home parks, RV parks that do not rent by the single night, or RV parks that do not allow tent camping.
      3. (iii) Eligibility requirements shall include:

1. (c) (c) Availability seven (7) days per week, at least six (6) months per year.
