(a)
- (1) The Permit Section may issue emergency permits on a case-by-case basis at the sole discretion of the Permit Section.
(2) Justifications for issuance of an emergency permit may include:
- (A) Natural or human-made disasters;
- (B) National security or national defense emergencies or issues;
- (C) Disruption of vital services;
- (D) Situations involving the probability of death or life-threatening injuries;
- (E) The seriousness of the stated emergency;
- (F) The danger to the traveling public from the standpoint of safety;
- (G) The condition and state of repair of the highway or highways involved; or
- (H) The ability of the highway or highways to safely accommodate the weight and dimensions of the vehicle.
(b) Persons who deal with the movement of emergency equipment shall preapply with the Permit Section, establish a bonded account, qualify for self-issue permits, and furnish the following information:
- (1) Make, model, and vehicle identification or serial number of each vehicle or equipment that would be used for emergency moves;
(2) Information on:
- (A) Axles;
- (B) Axle spacings;
- (C) Weights; and
- (D) Dimensions;
- (3) The type of emergencies to which the entity responds; and
- (4) Other information as deemed necessary by the Commander.
(c)
- (1) A permit issued for emergency movement will be a single-trip permit.
- (2) A separate permit for return of the vehicle or equipment shall be obtained.
- (3) Continuous movement will not be authorized for a nonemergency return trip.
