(a)
- (1) An application shall not be submitted and a permit shall not be issued for any vehicle, vehicle combination, load, or any other type of conveyance, whether towed, trailered, selfpropelled, or otherwise transported or moved, unless it is capable of maintaining a speed of forty miles per hour (40 m.p.h.) on any street, road, or highway on which it is permitted to move.
- (2) The Permit Section may grant exceptions for houses or for highly specialized equipment used to move extraordinary loads a relatively short distance with special requirements mandated by an Arkansas Department of Transportation engineer.
(b) Towing of manufactured home units and mobile homes.
- (1) No person shall drive a vehicle that is towing a manufactured home or mobile home at a speed greater than fifty-five miles per hour (55 m.p.h.).
- (2) On roads upon which the posted speed limit is less than fifty-five miles per hour (55 m.p.h.), the operator of the permitted vehicle shall observe the posted speed limit.
- (3) The department may set minimum and maximum speed limits different from those posted or may set a speed limit less than the maximum provided in this subsection and subsection (c) of this section for a vehicle towing a manufactured home or mobile home by noting any speed restriction on the oversize load permit issued to that vehicle by the department.
- (c) The maximum speed limit for all vehicles/loads traveling under authority of an oversize or overweight permit shall be the posted speed limit, unless a different speed restriction is noted on the oversize or overweight permit issued to that vehicle/load by the department.
