As used in this part:

1. (1) “A.C.A.” means the Arkansas Code;
2. (2) “Chief” means the Chief of the Arkansas Highway Police Division of the Arkansas Department of Transportation;
3. (3) “Commander” means the Arkansas Highway Police Division of the Arkansas Department of Transportation officer in charge of the Arkansas Highway Police Division of the Arkansas Department of Transportation Permit Section;
4. (4) “Commission” means the State Highway Commission;
5. (5) “Commissioner” means a member of the State Highway Commission;
6. (6) “Department” means the Arkansas Department of Transportation;
7. (7) “Director” means the Director of State Highways and Transportation;
8. (8) “Division” means the Arkansas Highway Police Division of the Arkansas Department of Transportation;
9. (9) “Manufactured home unit” means a structure constructed for use as a dwelling, office, or classroom which is more than eight feet (8') in width or sixty feet (60') in length and is capable of being moved upon the highways when combined with a pulling vehicle;
10. (10) “Manufactured home unit width” means the largest overall width of a manufactured home in the traveling mode, including bay windows, roof projections, overhangs, or eaves under which there is no interior space;
11. (11) “Master agreement” means a document executed by a person wishing to transport a nondivisible overweight load on a weight-restricted highway;
12. (12) “Multistate state envelope permit” means a single trip permit issued to a vehicle with a nonreducible load to travel through two (2) or more states within the Southern Association of State Highway and Transportation Officials region;
13. (13) “Operator” means a person who drives or is in actual physical control of a motor vehicle upon a highway;
14. (14) “Overwidth manufactured home unit” means a manufactured home unit in excess of eight feet (8') in width;

    1. (A) “Permit” means a document issued by the Permit Section which gives the bearer permission to move an oversize vehicle laden or unladen along specific routes during a specified period of time with certain restrictions.
    2. (B) The term "permit" shall include electronic media displayed on a mobile device provided that device shall have a screen size of at least seven inches (7");
16. (16) “Permit Section” means the Permit Section of the Arkansas Highway Police Division of the Arkansas Department of Transportation;
17. (17) “Permittee” means the person to whom the Permit Section has issued a permit;
18. (18) “Person” means a natural person, firm, partnership, corporation, association, or any political subdivision of the State of Arkansas;

19. (19) “Policy” means an established procedure pertaining to a specific activity of the:

    1. (A) Permit Section;
    2. (B) Arkansas Highway Police Division of the Arkansas Department of Transportation;
    3. (C) Arkansas Department of Transportation; or
    4. (D) State Highway Commission;

20. (20)

    1. (A) “Structure” means a building, either portable or permanent, other than a manufactured home unit, which cannot be disassembled or reduced in size without substantial damage to the structure, and:

       1. (i) Where any person lives or carries on a business or other calling;

       2. (ii) Where people assemble for purposes of:

          1. (a) (a) Business;
          2. (b) (b) Government;
       3. (c) (c) Education;

       4. (d) (d) Religion;

          1. (e) (e) Entertainment; or
          2. (f) (f) Public transportation; or
       5. (iii) Which is customarily used for overnight accommodation of persons, whether or not a person is actually present.
    2. (B) Each unit of a structure divided into separately occupied units is itself a structure;
21. (21) “Traveled way” means the portion of the roadway for the movement of vehicles, exclusive of shoulders, and auxiliary lanes; and

22. (22)

    1. (A) “Vehicles of special design” means any pneumatic or rubber-tired mobile construction vehicle or equipment carrying no load other than its own weight that has been reduced in size and weight until further reduction is impractical.

    2. (B) For purposes of this part, the following terms are considered synonymous:

       1. (i) Load;
       2. (ii) Vehicle with load;
       3. (iii) Laden;
       4. (iv) Vehicle or cargo; and
       5. (v) Vehicle and cargoes.
