(a)

1. (1) All carriers by motor vehicles are required to file public liability and property damage insurance or, in lieu thereof, a certificate of insurance on the form approved by the State Highway Commission with minimum liability as set out in the Arkansas public liability and property damage endorsement which must be attached.
2. (2) The endorsement on public liability and property damage insurance shall be on the form prescribed.

(b) Schedule of minimum limits — Liability.

1. (1) On each motor vehicle used in the transportation of property:

   1. (A) Fifty thousand dollars ($50,000) for bodily injuries to or death of one (1) person;
   2. (B) One hundred thousand dollars ($100,000) for bodily injuries to or death of all persons injured or killed in any one (1) accident; and
   3. (C) Thirty thousand dollars ($30,000) for loss or damage in any one (1) accident to property of others.

2. (2) On each motor vehicle used in the transportation of persons having a seating capacity of twelve (12) passengers or less:

   1. (A) Fifty thousand dollars ($50,000) for bodily injuries to or death of one (1) person;
   2. (B) Eighty thousand dollars ($80,000) for bodily injuries to or death of all persons injured or killed in any one (1) accident; and
   3. (C) Thirty thousand dollars ($30,000) for loss or damage in any one (1) accident to property of others.

3. (3) On each motor vehicle used in the transportation of persons having a seating capacity of thirteen (13) to twenty (20) passengers inclusive:

   1. (A) Fifty thousand dollars ($50,000) for bodily injuries to or death of one (1) person;
   2. (B) One hundred twenty thousand dollars ($120,000) for bodily injuries to or death of all persons injured or killed in any one (1) accident; and
   3. (C) Thirty thousand dollars ($30,000) for loss or damage in any one (1) accident to property of others.

4. (4) On each motor vehicle used in the transportation of persons having a seating capacity of twenty-one (21) to thirty (30) passengers inclusive:

   1. (A) Fifty thousand dollars ($50,000) for bodily injuries to or death of one (1) person;
   2. (B) One hundred sixty thousand dollars ($160,000) for bodily injuries to or death of all persons injured or killed in any one (1) accident; and
   3. (C) Thirty thousand dollars ($30,000) for loss or damage in any one (1) accident to property of others.

5. (5) On each motor vehicle used in the transportation of persons having a seating capacity of thirty-one (31) passengers or over:

   1. (A) Fifty thousand dollars ($50,000) for bodily injuries to or death of one (1) person;
   2. (B) Two hundred thousand dollars ($200,000) for bodily injuries to or death of all persons injured or killed in any one (1) accident; and
   3. (C) Thirty thousand dollars ($30,000) for loss or damage in any one (1) accident to property of others.

6. (6) On vehicles used to transport hazardous material and hazardous waste.

   1. (A)

(i) Type of carriage: for-hire and private in interstate, foreign, and/or intrastate commerce.

1. (ii) Kind of equipment: freight vehicles of ten thousand pounds (10,000 lbs.) or more gross vehicle weight rating.

   1. (iii) Commodity transported:

(b) (b) In bulk Class A or B explosives, poison gas, or compressed gas; or

1. (c) (c) Highway route-controlled quantity radioactive materials as defined in 49 C.F.R. § 173.403.

   1. (iv) Liability limit: five million dollars ($5,000,000).

   2. (B)

      1. (i) Type of carriage: for-hire and private in interstate or foreign commerce in any quantity, or in intrastate commerce, bulk only.
      2. (ii) Kind of equipment: freight vehicles of ten thousand pounds (10,000 lbs.) or more gross vehicle weight rating.
      3. (iii) Commodity transported:

(b) (b) Hazardous waste, hazardous materials, and hazardous substances defined in 49 C.F.R. § 171.8 and listed in 49 C.F.R. § 172.101, but not mentioned above or below.

1. (iv) Liability limit: one million dollars ($1,000,000).

   1. (C)

      1. (i) Type of carriage: for-hire and private in interstate commerce.
      2. (ii) Kind of equipment: freight vehicles under ten thousand pounds (10,000 lbs.) gross vehicle weight rating.
      3. (iii) Commodity transported:

(b) (b) Any quantity of poison gas (Poison A); or

1. (c) (c) Highway route-controlled quantity radioactive materials as defined in 49 C.F.R. § 173.403.

   1. (iv) Liability limit: five million dollars ($5,000,000).

      1. (c) Schedule of minimum limits — Cargo. All common carriers of property by motor vehicle are required to file cargo insurance with minimum liability of five thousand dollars ($5,000) with cargo endorsement attached.
