- (a) The procurement process, requisite evaluations, and selection is a very competitive process.
- (b) The Arkansas Department of Transportation has the obligation to keep certain proposer information confidential through the procurement and selection process.
(c) The information of unsuccessful proposers should remain confidential unless otherwise required for release pursuant to:
- (1) Statute;
- (2) Court order; or
- (3) Some other requirement.
- (d) Some portions of the selected design-builder’s information may be proprietary and not subject to release under the Freedom of Information Act of 1967, Arkansas Code § 25-19-101 et seq.
