- (a) The use of the design-build method is solely at the discretion of the State Highway Commission and the final determination of whether a project is selected by the Arkansas Department of Transportation for utilization of design-build methodology is the responsibility of the commission.
- (b) Potential design-build projects may be proposed by department staff for consideration by the Director of State Highways and Transportation.
