- (a) A utility facility located on private right-of-way or easement (outside the existing highway right-of-way) is considered to be eligible for reimbursement of the cost of replacement right-of-way.
- (b) Copies of an easement or affidavit verifying the utility owner's right of occupancy must be submitted with the relocation proposal.
- (c) There will be no charge to the Arkansas Department of Transportation for that portion of the utility owner's existing private right-of-way or easement being transferred to the department for highway purposes.
