The covenant not to sue should be notarized indicating:

1. (1) The parties of the covenant;
2. (2) The date and location of the accident;
3. (3) Any conditions under which the covenant is being executed;
4. (4) The date the covenant is being executed; and
5. (5) The signatures of the parties of the covenant, and such signatures to be made in the presence of a notary.
