If a person or entity other than a permit holder fails to pay their fine when due and has either failed to file a timely appeal to circuit court or more than thirty (30) days has passed since the entry of a final order on appeal, the Director of Arkansas Tobacco Control may immediately and without further notice:

1. (1) Confiscate or seal any and all cigarettes and other tobacco products on said person or entity's business premises until a hearing is held to show cause why the person or entity should not be found in contempt of the board’s orders and their confiscated inventory be destroyed;
2. (2) Be fined up to one thousand dollars ($1,000); or
3. (3) Any combination thereof.
