As used in this part:

1. (1) "Drug" means a compound, substance, or preparation, and any component of a compound, substance, or preparation, other than "food and food ingredients", "dietary supplements", or "alcoholic beverages" that is the following:

   1. (A) Recognized in the:

      1. (i) Official United States Pharmacopoeia, official Homeopathic Pharmacopoeia of the United States, or official National Formulary; and
      2. (ii) Supplement to any of them;
   2. (B) Intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease; or
   3. (C) Intended to affect the structure or any function of the body;
2. (2) "Prescription" means an order, formula, or recipe issued in any form of oral, written, electronic, or other means of transmission by a veterinarian;
3. (3) "Veterinarian" means a practitioner of veterinary medicine duly licensed under the laws of this or some other state; and

4. (4)

   1. (A) "Veterinarian-client-patient relationship" means:

      1. (i) The veterinarian has assumed the responsibility for making medical judgments regarding the health of the animal and the need for medical treatment;
      2. (ii) The client, that is, the owner or caretaker, has agreed to follow the instruction of the veterinarian; and
      3. (iii) There is sufficient knowledge of the animal by the veterinarian to initiate at least a general or preliminary diagnosis of the medical condition of the animal.

   2. (B) This means that:

      1. (i) The veterinarian has recently seen and is personally acquainted with the keeping and care of the animal, by virtue of:

         1. (a) (a) An examination of the animal; or
         2. (b) (b) Medically appropriate and timely visits to the premises where the animal is kept; and
      2. (ii) The practicing veterinarian is readily available for follow-up in case of adverse reactions or failure of the regimen of therapy.
