(a) Annual review of cases.
- (1) Individuals who are determined ineligible for VR services are to be provided an opportunity for a review of the ineligibility determination no later than twelve (12) months after the decision is made.
- (2) The VR counselor should contact the prior applicant to determine if they would like an annual review and document this review in AWARE.
(b) When is an annual review not required?
- (1) Annual reviews of eligibility are required for any closures based on a determination that the individual is incapable of achieving an employment outcome (applicant status, “Disability Too Significant to Benefit from Service”).
(2) However, annual eligibility reviews are not required in the following circumstances:
- (A) The individual refuses the opportunity for review;
- (B) The individual is no longer present in the state or his or her whereabouts are unknown;
- (C) Medical information upon which the ineligibility decision was based indicated the condition was rapidly progressive or terminal; or
- (D) The individual is deceased.
