- (a) Eligibility determinations must be made within sixty (60) calendar days after the consumer has applied for OIB services.
(b) Exceptions can only occur if the consumer:
- (1) Is notified in writing that exceptional and unforeseen circumstances beyond the agency's control prevent making a determination within the prescribed time (sixty (60) calendar days); and
- (2) Agrees that the extension of time is necessary.
- (c) This notification must include a timeframe for completion of eligibility determination as well as the reason for the extension request.
(d) The determination of need for this exception:
- (1) Must be made within forty-five (45) calendar days after application for OIB services; and
- (2) Requires approval by the counselor’s Area Manager.
- (e) The extension must be documented in a case note with a description of the reason and the consumer’s consent to the extension date.
- (f) A signed copy of the written notification provided to the consumer must be attached to the case note.
- (g) The Division of State Services for the Blind allows extensions for up to thirty (30) days past the original eligibility deadline.
Codification Notes: “OIB” means older individuals who are blind.
