(a)

1. (1) A child of a qualifying member is eligible to receive a survivor annuity benefit under Arkansas Code § 24-7-710 if the child qualifies as a dependent child.

2. (2) A qualifying member’s child shall be eligible to qualify as a dependent child or maintain his or her status as a dependent child if:

   1. (A) The qualifying member was the legal parent of the child at the time of the qualifying member’s death; and
   2. (B) The child meets all other requirements to qualify as a dependent child or maintains his or her status as a dependent child.

(b) A child of a qualifying member qualifies as a dependent child if the child is:

1. (1) Not older than twenty-two (22) years of age; or
2. (2) Has been adjudged physically or mentally incapacitated by a court of competent jurisdiction.
