(a) A member shall be considered active for the purpose of an eligible survivor qualifying for survivor annuity benefits under Arkansas Code § 24-7-710 if:

1. (1) The member has at least:

   1. (A) Ten (10) days of service credit in each prior quarter of the fiscal year from the time the fiscal year began or the member was employed by a covered employer, whichever occurs last; and
   2. (B) One (1) quarter with ten (10) days of service; or

2. (2) Either of the following apply to the member:

   1. (A) The member has earned at least ten (10) days of service credit in the quarter of the member’s death and in each quarter before the member’s death, collectively; or
   2. (B) Less than ten (10) working days have elapsed in the quarter of the member’s death.
