1. (a)

   1. (1) The right of a person to an annuity, to the return of accumulated contributions, the annuity itself, any annuity option, any other right accrued or accruing under the provisions of this subpart, and all moneys belonging to a plan shall not be subject to:

      1. (A) Execution;
      2. (B) Garnishment;
      3. (C) Attachment;
      4. (D) The operation of bankruptcy or insolvency laws; or
      5. (E) Any other process of law.

   2. (2) The rights described in subdivision (a)(1) of this section shall not be assignable except:

      1. (A) When a qualified domestic relations order has been filed pursuant to Arkansas Code § 9-18-101 et seq.; or
      2. (B) As specifically provided in this part.
2. (b) An employer shall have the right of setoff for any claim arising from embezzlement by, or fraud of, a member, retirant, or beneficiary.
