1. (a) It is declared to be the state’s public policy that district judges and former municipal judges may retire or be retired when that course appears to be in the best interest:

   1. (1) Of the official concerned; and
   2. (2) For the public welfare.

2. (b) Factors to be considered for retirement are:

   1. (1) Physical disability;
   2. (2) Advanced age; or
   3. (3) Other infirmities calculated to materially impair the conduct of judicial duties.
