1. (a) Disclosure of information from Arkansas Public Employees’ Retirement System records and meetings shall be open to the public as provided by:

   1. (1) Arkansas Code § 25-19-101;
   2. (2) Arkansas Code § 21-12-203; and
   3. (3) Other applicable law.
2. (b) The Executive Director of the Arkansas Public Employees’ Retirement System shall seek the advice of the Attorney General when necessary regarding release of information as provided herein.

3. (c) No information on a member’s record will be given to any individual or agency except under the following conditions:

   1. (1) The individual member may request information on his or her own account by coming to the system office in person or by requesting such information in writing; or
   2. (2) Any person other than the member may receive information on the individual member’s account by furnishing the system with a signed, notarized statement from such individual member asking that such information be given to the named third party.
