- (a) Whenever any rule requires a document to be filed with any pleading or other document, or in all other cases when a document filed by a party refers or cites to another document previously filed with the secretary, whether for incorporation by reference into such document or to otherwise support an assertion made in such document, such document may be incorporated by reference if it is already on file with the Arkansas Public Service Commission.
(b) Such reference or citation shall include the:
- (1) Name of the previously filed document;
- (2) Docket number in which it was filed; and
- (3) Filing date.
(c) Incorporation by reference is permitted only if the previously filed document is:
- (1) Identical to the referenced document; and
- (2) Is not under seal.
- (d) Any document incorporated by reference shall not be attached to the referencing document.
- (e) The secretary shall include in a record on appeal any document incorporated by reference in a docket if a party requests in writing its inclusion in the record.
