1. (a) The proposed merger or acquisition or attempted acquisition of control of a public utility that has not been approved by the public utility’s board of directors shall require the filing of a formal application under each of the provisions of Arkansas Code § 23-3-301 et seq.
2. (b) Exception. This section does not apply to telecommunications providers unless such provider is a nonelecting ILEC.
