- (a) The Arkansas Racing Commission may summon any licensee or the licensee’s agents or employees to appear to testify before it or its agents with regard to the conduct of any licensee or the agents or employees of any licensee.
- (b) All such testimony shall be under oath and may embrace any matters which the commission or its agents may deem relevant to the discharge of its official duties.
- (c) Any person so summoned to appear shall have the right to be represented by counsel.
- (d) Any testimony so taken may be used by the commission as evidence in any proceeding or matter then before it or the commission or which may later come before it or the commission.
- (e) Failure to so appear and testify fully at the time and place designated, unless excused, shall constitute grounds for the revocation or suspension of any license held by the person summoned or his or her principal or employer.
