Employee Licenses and registration — Key Employee and General Employee Licenses
Arkansas Constitution, Amendment 100, sec. 4
(a)
- (1) Except in cases of emergency and/or unavoidable temporary incidental entry, no person may work or provide services to the casino gaming operations of a casino licensee in the State of Arkansas unless the person has a current Key Employee License or a General Employee License issued by the Arkansas Racing Commission, as provided in this part.
(2) The Key Employee License or General Employee License requirements apply to persons who have direct access to the casino gaming:
- (A) Equipment;
- (B) Games;
- (C) Surveillance; or
- (D) Computer systems.
(b)
- (1) Employees who perform duties in the racing industry of a casino licensee must have a Racing License.
- (2) In the event the employee is assigned to work in both the racing and casino gaming areas, the employee must obtain both a General Employee License and a Racing License.
- (c) Key Employee Licenses and General Employee Licenses are issued for three-year periods.
- (d) Qualifications for a Key Employee License or General Employee License must meet the same qualifications as stated in 23 CAR § 358-311, qualifying as a Person Related with a Service Industry License.
(e)
- (1) Key Employee Licenses or General Employee Licenses issued pursuant to Rules for Franchise Holders Operating Electronic Games of Skill, 23 CAR pt. 355, shall also be valid Key Employee Licenses or General Employee Licenses for casino gaming and shall be subject to the requirements of this part.
- (2) Such Key Employee Licenses or General Employee Licenses shall expire and be subject to renewal three (3) years from the date of issuance of such license for electronic games of skill.
(f)
- (1) Employees that are not involved in casino gaming operations and not subject to the provisions of 23 CAR § 358-328 or 23 CAR § 358-329, shall not be registered with the commission and the registration shall be treated the same as employees’ licenses for the purpose of 23 CAR §§ 358-334, 358-339, 358-340, and 358-345.
- (2) The registration fees shall be deposited pursuant to the provisions of 23 CAR § 358-603(f).
