- (a) The burden of proof for the granting of any approval required or permitted by this part is at all times upon the applicant.
- (b) Each applicant shall satisfy the Arkansas Racing Commission or the commission, as the case may be, that the granting of any approval required or permitted by this part is consistent with the state policies concerning gaming set forth in this part.
