Field trial of associated equipment
Arkansas Constitution, Amendment 100, sec. 4
(a)
- (1) The Arkansas Racing Commission may allow or require that the associated equipment be tested at licensed gaming establishments for not more than one hundred eighty (180) days under terms and conditions that the commission may approve or require.
- (2) The commission may allow an additional test period upon written request of the manufacturer or distributor of associated equipment.
- (b) A manufacturer of associated equipment shall not modify associated equipment during the test period without the prior oral approval of the commission.
(c)
- (1) The commission may order termination of the test period, if the commission determines, in the commission’s sole and absolute discretion, that the manufacturer or the distributor of the associated equipment or licensed gaming establishment has not complied with the terms and conditions of the order allowing or requiring a test period.
- (2) If the test period is terminated due to the licensed gaming establishment’s failure to comply with the terms and conditions of the order allowing or requiring a test period, the commission may order that the test be conducted at another licensed gaming establishment.
