(a)
- (1) The Arkansas Racing Commission shall determine if the initial application complies with all the requirements provided in this part and if any deficiency is found, it shall notify the applicant of the deficiency or deficiencies within twenty (20) days following the filing of the initial application with the commission.
- (2) The commission shall not evaluate an incomplete initial application.
(b)
(1) Once the commission has determined that the initial application filed is complete, the commission shall:
- (A) Accept the application and initiate the procedure for considering the same;
- (B)
(i) Notify in writing the applicant or his or her representative, if any, that the application has been accepted for consideration.
- (ii) Said notice shall also include:
- (a) (a) The date of said acceptance;
(b) (b) The file number of the application; and
(c) (c) A caution to the applicant that the fact that the application has been accepted for consideration does not mean that the applicant has complied with the requirements of this part to issue the license;
- (C) Analyze and evaluate the information offered in the application and any other information necessary to determine if the requested license should be granted;
- (D) Make a decision with respect to the requested license; and
- (E) Notify the applicant of its decision.
- (2) If the decision consists of a denial of the license, the commission shall inform the applicant the reason or reasons for the denial and of his or her right to request a reconsideration of the decision of the commission following the adjudicative procedures provided in 23 CAR § 355-401 et seq. of this part.
(3) For purposes of this part, a denial of a license application shall be considered a final order of the commission, after the adjudication process.
- (c) The commission, at any time, may request from an applicant for an employee license any other information it may deem necessary in order to make a decision with respect to the application.
