(a) Each applicant for an employee license shall provide the Arkansas Racing Commission with the necessary information, documentation, and guarantees which establish through clear and convincing evidence that the applicant:

1. (1) Is older than twenty-one (21) years of age;
2. (2) Is a citizen of the United States of America or is authorized in accordance with the applicable federal laws or regulations to work in the United States of America;
3. (3) Possesses good character and reputation, in addition to being honest and having integrity; and
4. (4) Has no physical or mental condition that prohibits the applicant from performing the essential functions of his or her job for which there is no reasonable accommodation.
