(a) Each applicant for an employee license shall provide the Arkansas Racing Commission with the necessary information, documentation, and guarantees which establish through clear and convincing evidence that the applicant:
- (1) Is older than twenty-one (21) years of age;
- (2) Is a citizen of the United States of America or is authorized in accordance with the applicable federal laws or regulations to work in the United States of America;
- (3) Possesses good character and reputation, in addition to being honest and having integrity; and
- (4) Has no physical or mental condition that prohibits the applicant from performing the essential functions of his or her job for which there is no reasonable accommodation.
- (b) Failure to comply with one (1) of the criteria established in subsection (a) of this section may be sufficient cause for the commission to deny an application for an employee license.
