(a)

1. (1) The franchise holder shall maintain a surveillance log or logs approved by the Arkansas Racing Commission.
2. (2) The log or logs shall be maintained by surveillance room personnel in the surveillance room.
3. (3) The commission staff and other staff authorized by the commission shall have access at all times to the log or logs.
4. (4) A log or logs entry shall be made in the surveillance log or logs of each surveillance activity.

5. (5) The following information shall be recorded in the surveillance log or logs:

   1. (A) The names of all persons entering or exiting the surveillance room;
   2. (B) A summary, including the date and time each surveillance activity commenced and terminated;
   3. (C) A record of any equipment or camera malfunctions;
   4. (D) A description of the activity observed or performed; and
   5. (E) Any additional information as required by the commission or its agents.

(b)

1. (1) A franchise holder shall maintain a security log of any and all unusual occurrences for which the assignment of a security department employee is made.

2. (2) Each incident, without regard to materiality, shall be assigned a sequential number and an entry made in the log or logs containing, at a minimum, the following information:

   1. (A) The assignment number;
   2. (B) The date of the incident;
   3. (C) The time of the incident;
   4. (D) The location of the incident;
   5. (E) The nature of the incident;
   6. (F) The person or persons involved in the incident; and
   7. (G) The security department employee or employees assigned.
