23 CAR § 350-103 – Penalties

(a) A violation of the provisions of Acts 2007, No. 388, by a licensed authorized organization shall be an unclassified misdemeanor punishable by a fine not to exceed five thousand dollars ($5,000) if prosecuted and convicted.
(b) A second or subsequent violation of the provisions of Acts 2007, No. 388, by a licensed authorized organization shall be an unclassified misdemeanor punishable by a fine not to exceed ten thousand dollars ($10,000) if prosecuted and convicted.
(c) Any person who conducts a game of bingo or a raffle without a permit issued under the provisions of Acts 2007, No. 388, shall be subject to the same penalties set forth under Arkansas Code § 5-66-118 with regard to the operation of a lottery.
(d) Information on possible criminal violations of Acts 2007, No. 388, shall be referred by the Department of Finance and Administration to the appropriate prosecuting attorney’s office.
