- (a) The Savings and Loan Association Board shall meet in Little Rock, Arkansas.
- (b) All communications to the board shall be addressed to: "Arkansas Savings and Loan Association Board 1 Commerce Way, Suite 402 Little Rock, Arkansas 72202 Attention: Savings and Loan Association Supervisor".
- (c) The office of the Supervisor of Savings and Loan Associations is open during business hours each day, Saturdays, Sundays, and legal holidays excepted.
- (d) General meetings of the board for the transaction of its business will be held at least quarterly at such places in the City of Little Rock and at such times as are scheduled by the board.
- (e) Special meetings of the board may be called by the chair and may be held at any time and place in the City of Little Rock as scheduled by the chair.
(f)
- (1) A quorum shall be required for any meeting of the board and shall consist of not less than a majority of the authorized number of members of the board.
- (2) At least three (3) board members eligible to vote must be present in order to consider any matter before the board.
- (g) A majority vote of the board members present and eligible to vote shall be required for approval of any action.
(h)
- (1) All members present except the chair shall be allowed to vote on all matters submitted to a vote of the board.
- (2) The chair can, but is not obligated to, vote whenever his or her vote will affect the result.
- (3) The chair can vote to break a tie or when his or her vote is necessary to determine a majority vote of the board.
(i)
- (1) The board delegates to the supervisor the power to conduct any inquiry, investigation, hearing, or other proceeding necessary to perform the duties and functions imposed by law.
- (2) The supervisor shall have custody of the official records of the board and shall be responsible for the maintenance and custody of all files and records of the board.
- (3) All orders and other actions of the board shall be signed by all members of the board voting in the majority and shall be authenticated by the supervisor.
- (4) The supervisor shall issue all notices of meetings and hearings and other process as may be directed by order of the board.
- (j) All notices of meetings and hearings shall show the time and place of the board’s meetings, and all meetings and hearings before the board or supervisor shall be open to the public.
- (k) The supervisor shall assign to each proceeding a title descriptive of the subject matter, which title will be placed on all notices issued, orders made, and papers filed in each proceeding.
(l)
- (1) All papers filed with the board and all exhibits to pleadings and testimony of witnesses shall be filed in six (6) copies and shall be printed or typewritten, with a clear margin of at least two inches (2”) at the top.
- (2) If typewritten, on one (1) side of the paper only, and as far as practicable shall be upon paper eight and one-half inches by fourteen inches (8 1/2" x 14”) except where exhibits may require a larger sheet.
- (3) Where such exhibits are on larger sheets, the same must be folded, if possible, so as to make a sheet of the above size.
- (m) The supervisor may require any pleading or petition to be made more specific, and may allow, or on his or her own motion require, amendments thereto, corrections thereof, or any omissions therein to be supplied.
(n)
- (1) The authority to issue orders requiring the attendance of a witness, from any place in the state, at any designated place of hearing for the purpose of taking the testimony of such witness orally before the board or the supervisor is hereby delegated to the supervisor.
(2) Orders for the production of books, accounts, papers, and other documents, unless issued by the board or the supervisor on its or his or her own motion, will only be issued in the discretion of the supervisor upon written petition which shall describe as accurately as possible the:
- (A) Books, accounts, papers, and other documents desired to be produced; and
- (B) Purpose of the production.
- (o) In computing the time within which an act must be performed after service by mail, the first day of receipt of the notice shall be excluded, and the last day shall be included, but if the last day shall fall on a Saturday, Sunday, or on a legal holiday, then the next business day shall be construed the last day.
(p)
- (1) All pleadings shall be served on all parties to the proceeding.
- (2) When any party has appeared by attorney, service by mail upon the attorney will be deemed proper service upon such party.
- (q) Any person requesting a copy of any public record on file with the supervisor shall pay the supervisor the sum of fifty cents (50¢) per page.
