23 CAR § 302-911 – Commencement of contested case — Notice of hearings

(a) Unless otherwise provided by statute, notice of a hearing shall be given at least fourteen (14) days prior to the hearing.
(b) The Securities Commissioner may issue a notice that sets the date and time of the hearing.
(c)
1. (1) The commissioner may amend the notice of hearing at any stage of the contested case prior to the close of evidence.
2. (2) The commissioner shall provide parties and intervenors with notice of the amendment and shall provide them with sufficient time to prepare their case in light of the amendment.
3. (3) A party that has requested a hearing on the original notice need not request a hearing on the amended notice and any such hearing shall proceed on the amended notice as if it were the original notice.
