- (a) Investigations conducted pursuant to Arkansas Code § 23-39-514 are not hearings, either formal or informal, as that term is used in this section.
- (b) Upon sufficient evidence, the Securities Commissioner shall enter an order directing an investigation and appointing investigative officers from the State Securities Department staff.
- (c) Any person compelled to appear, or who appears by his or her own request, in person at any investigation proceeding may be accompanied, represented, and advised by counsel.
(d) The right to be accompanied, represented, and advised by an attorney means the right of a person testifying to have an attorney:
- (1) Present during any investigative proceeding;
- (2) Advise such person before, during, and after the conclusion of such examination;
- (3) Question such person briefly at the conclusion of the examination to clarify any of the answers such person has given; and
- (4) Make summary notes during such examination solely for the use of such person.
