Arkansas Code § 23-42-204
- (a) Investigations conducted pursuant to Arkansas Code § 23-42-205 of the Arkansas Securities Act, Arkansas Code § 23-42-101 et seq., are not hearings, either formal or informal, as that term is used in this section.
- (b) Upon sufficient evidence, the Securities Commissioner shall enter an order directing an investigation and appointing investigative officers from the staff.
- (c) Any person compelled to appear, or who appears by his or her own request in person at any investigative proceeding, may be accompanied, represented, and advised by counsel.
(d) The right to be accompanied, represented, and advised by counsel shall mean the right of a person testifying to have an attorney present with him or her during any investigative proceeding and to have his or her attorney:
- (1) Advise such person before, during, and after the conclusion of the examination;
- (2) Question such person briefly at the conclusion of the examination to clarify any of the answers such person has given; and
- (3) Make summary notes during the examination solely for the use of such person.
