23 CAR § 87-109 – Effective date for existing contracts

(a) A contract that provides healthcare benefits and that was issued before the effective date of this part shall be brought into compliance with this part by:
1. (1) The later of:
  1. (A) The next anniversary date or renewal date of the contract; or
  2. (B) Twelve (12) months following July 1, 2010; or
2. (2) The expiration of any applicable collectively bargained contract pursuant to which it was written.
(b) For the transition period between the adoption of this part and the timeframe for which plans are to be in compliance pursuant to subsection (a) of this section, a plan that is subject to the prior COB requirements shall not be considered a noncomplying plan by a plan subject to the new COB requirements, and if there is a conflict between the prior COB requirements under the prior rule and the new COB requirements under the amended rule, the prior COB requirements shall apply.
