(a)
- (1) "Intensive care unit indemnity coverage" is a policy of accident and health insurance that provides daily benefits for hospital confinement in an intensive care unit on an indemnity basis in an amount not less than one hundred fifty dollars ($150) per day and not less than fifteen (15) days during any one (1) period of confinement for each person insured under the policy.
- (2) No elimination period shall be allowed.
(b) A definition of “hospital intensive care unit” shall not be more restrictive than the following:
(1) Specifically designated facility of the hospital that:
- (A) Provides the highest level of medical care; and
- (B) Is restricted to those patients who are physically, critically ill or injured;
(2) Such facilities must be separate and apart from:
- (A) The surgical recovery room; and
- (B) Rooms, beds, and wards customarily used for patient confinement; and
(3) They must be:
- (A) Permanently equipped with special equipment for the care of the critically ill or injured; and
- (B) Under close observation by trained and qualified personnel assigned on a full-time basis exclusively to that unit.
