- (a) In his or her discretion, the Insurance Commissioner, or appointed hearing officer, is authorized to require parties in an adjudicative proceeding under this subpart to participate in a settlement conference at a date, time, or location specified by the commissioner or hearing officer unless the parties mutually agree to a different time, date, and location.
- (b) No statements made during the conference or prepared for purposes of this conference shall be admissible in any adjudicative hearing.
- (c) A conference under this section, if requested, shall be attended by the identified parties and attorneys, if any, and may be required to occur as a condition before an adjudicative hearing is held on the matter.
(d) The conference may be held:
- (1) In person;
- (2) Over the phone; or
- (3) Through live video conferencing.
