As used in this part:
(1) "Accident and health insurer" means:
- (A) Any insurer which issues "accident and health" insurance as defined in Arkansas Code § 23-62-103;
- (B) A hospital or medical services corporation; or
- (C) A health maintenance organization;
(2) The following services will be considered “complications of pregnancy”:
(A) Hospital confinement required to treat conditions, such as the following, in a pregnant female:
- (i) Acute nephritis;
- (ii) Nephrosis;
- (iii) Cardiac decompensation;
- (iv) HELLP syndrome;
- (v) Uterine rupture;
- (vi) Amniotic fluid embolism;
- (vii) Chorioamnionitis;
- (viii) Fatty liver in pregnancy;
- (ix) Septic abortion;
- (x) Placenta accreta;
- (xi) Gestational hypertension;
- (xii) Puerperal sepsis;
- (xiii) Peripartum cardiomyopathy;
- (xiv) Cholestasis in pregnancy;
- (xv) Thrombocytopenia in pregnancy;
- (xvi) Placenta previa;
- (xvii) Placental abruption; (xviii) Acute cholecystitis and pancreatitis in pregnancy;
- (xix) Postpartum hemorrhage;
- (xx) Septic pelvic thromboplebitis;
- (xxi) Retained placenta;
- (xxii) Venous air embolus associated with pregnancy; (xxiii) Miscarriage; or
(xxiv)
- (a) (a) An emergency C-section:
(1) (1) Required because of:
- (A) (A) Fetal or maternal distress during labor;
- (B) (B) Severe preeclampsia;
- (C) (C) Arrest of descent or dilatation;
- (D) (D) Obstruction of the birth canal by fibroids or ovarian tumors; or
(2) (2) Necessary because of the sudden onset of a medical condition manifesting itself by acute symptoms of sufficient severity that, in the absence of immediate medical attention, will result in placing the life of the mother or fetus in jeopardy.
- (b) (b) For purposes of this part, a C-section delivery is not considered to be an emergency C-section if it is:
- (1) (1) Merely for the convenience of the patient and/or doctor; or
(2) (2) Solely due to a previous C-section; and
(B) Treatment, diagnosis, or care for conditions, including the following, in a pregnant female when the condition was caused by, necessary because of, or aggravated by the pregnancy:
- (i) Hyperthyroidism;
- (ii) Hepatitis B or C;
- (iii) HIV;
- (iv) Human papillomavirus;
- (v) Abnormal Pap smear;
- (vi) Syphilis;
- (vii) Chlamydia;
- (viii) Herpes;
- (ix) Urinary tract infections;
- (x) Thromboembolism;
- (xi) Appendicitis;
- (xii) Hypothyroidism;
- (xiii) Pulmonary embolism;
- (xiv) Sickle cell disease;
- (xv) Tuberculosis;
- (xvi) Migraine headaches;
- (xvii) Depression; (xviii) Acute myocarditis;
- (xix) Asthma;
- (xx) Maternal cytomegalovirus;
- (xxi) Urolithiasis;
- (xxii) DVT prophylaxis; (xxiii) Ovarian dermoid tumors;
- (xxiv) Biliary atresia and/or cirrhosis;
- (xxv) First trimester adnexal mass;
- (xxvi) Hydatidiform mole; or (xxvii) Ectopic pregnancy;
- (3) "Contract" or “policy” shall mean any contract or policy of insurance, coverage by a health maintenance organization, indemnity, medical or hospital service, suretyship, or annuity issued, proposed for issuance, or intended for issuance by any person; and
(4) "Insurer" means any:
- (A) Stock or mutual insurance company;
- (B) Reciprocal insurer;
- (C) Stipulated premium insurer;
- (D) Mutual assessment life or accident and health insurer;
- (E) Farmers mutual aid association;
- (F) Hospital or medical services corporation;
- (G) Health maintenance organization; or
- (H) Fraternal benefit society.
Codification Notes: "HELLP syndrome" refers to a condition characterized by hemolysis, elevated liver enzymes, and low platelets. "HIV" means human immunodeficiency virus. "DVT" means deep venous thrombosis.
