As used in this part:
(1) “Apprentice” means a qualified person who:
- (A) Is enrolled as required in an apprenticeship program recognized by the Arkansas Fire Protection Licensing Board; and
- (B) May perform work entitled by the licensee under the direct supervision of a licensed employee;
(2) “Authority Having Jurisdiction (AHJ)” means the organization, office, or individual responsible for:
- (A) Enforcing the requirements of a code or standard; or
- (B) Approving equipment, materials, an installation, or a procedure;
(3)
- (A) “Branch office” means an office that has a different location but the same name and tax identification number as the primary applicant.
- (B) If a certified firm obtained a certificate of registration for a separate business location or locations or office or offices, on or before the effective date of this rule, the Arkansas Fire Protection Licensing Board will consider that separate business location or office to be a branch office as defined by this part;
- (4) “Certificate” means the certificate of registration issued by the Arkansas Fire Protection Licensing Board to a firm for the purpose of granting permission to such firm to perform any act for which the law requires a certificate of registration;
- (5) “Certified firm” means any business owned by an individual, partnership, corporation, or association holding a current certificate of registration issued by the Arkansas Fire Protection Licensing Board;
(6) “Fixed fire protection system” means fire extinguisher or fire suppression systems, including without limitation:
- (A) Fire extinguishing or fire suppression systems installed to protect the hoods and ductwork of exhaust systems designed for the removal of smoke and grease-laden vapors from commercial cooking equipment; and
- (B) Listed or approved fire protection systems or suppression systems installed and maintained according to the standards adopted in the rules of the Arkansas Fire Protection Licensing Board;
- (7) “Hydrostatic testing” means pressure testing by hydrostatic methods;
- (8) “License” means a written document issued by the Arkansas Fire Protection Licensing Board to an individual for the purpose of granting permission to such individual to perform any act for which the law requires a license;
(9)
(A) “Licensee” means a specific:
- (i) Individual to whom a license or permit has been issued by the Arkansas Fire Protection Licensing Board; or
- (ii) Firm to which a certificate of registration has been issued by the Arkansas Fire Protection Licensing Board;
- (10) “NFPA” means the National Fire Protection Association, Inc., a nationally recognized standard-making organization;
- (11) “Portable fire extinguisher” means any device that contains within it chemicals, fluids, powder, liquids, or gases for extinguishing fires;
- (12) “Recharge” means to fill a portable fire extinguisher or a fixed fire protection system with a charge the second and all succeeding times the system is serviced;
(13) “Repair” means any work performed on or to any portable fire extinguisher or fixed fire protection system and not defined as:
- (A) Charging;
- (B) Recharging;
- (C) Hydrostatic testing; or
- (D) Inspecting;
- (14) “Service tag” means a tag on a portable fire extinguisher or fixed fire protection system that serves as evidence that some action was performed by a licensee;
- (15) “Test” means to subject any portable fire extinguisher or fixed fire protection system to any procedure necessary to ensure its proper operation or installation;
(16) “Service” means to physically install portable fire extinguisher or fixed fire protection systems by:
- (A) Charging;
- (B) Filling;
- (C) Maintaining;
- (D) Recharging;
- (E) Refilling;
- (F) Repairing;
- (G) Hanging;
- (H) Locating; or
- (I) Retesting, including hydrostatic testing; and
- (17) “Standards” means nationally recognized standards adopted herein.
