(a) Purpose.

1. (1) The purpose of this part is to establish:

   1. (A) Minimum safety standards for the maintenance, inspection, tests, and operation of all elevators and escalators and other conveyances;
   2. (B) Minimum safety standards for the construction of new:

(i) Elevators;

1. (ii) Dumbwaiters;

   1. (iii) Escalators; and

      1. (iv) Other conveyances;

   2. (C) Minimum safety standards for the alteration of existing:

      1. (i) Elevators;
      2. (ii) Dumbwaiters;
      3. (iii) Escalators; and
      4. (iv) Other conveyances;

   3. (D) Minimum safety standards for existing:

      1. (i) Elevators;
      2. (ii) Escalators;
      3. (iii) Dumbwaiters; and
      4. (iv) Other conveyances;
   4. (E) Rules prescribing fees;
   5. (F) Rules for the application and granting of variances and exceptions;
   6. (G) Minimum standards for licensing and qualifying elevator inspectors, elevator contractors, and elevator mechanics; and
   7. (H) Rules for the effective administration and enforcement of the elevator safety law, Arkansas Code § 20-24-101 et seq.

2. (2) This part is intended to protect the general public, invitees, guests, employees, and all persons who could be reasonably expected to use:

   1. (A) An elevator;
   2. (B) An escalator;
   3. (C) A dumbwaiter; or
   4. (D) Other conveyance.

(b) Scope and application.

1. (1) This part applies to all elevators, escalators, dumbwaiters, and other conveyances in the State of Arkansas, except as specifically exempted herein.

2. (2) This part does not apply to:

   1. (A) A conveyor, chain or bucket hoist, construction hoist, or similar devices used for the primary purpose of elevating or lowering materials and is not used for elevating or lowering workers or other riders, including those workers loading and unloading; and
   2. (B) Tiering, piling, feeding, or similar machines or devices giving service within only one (1) story.
3. (3) Conveyances installed in private single-family dwellings are exempt from the testing and inspection requirements of Arkansas Code § 20-24-112 and the permitting requirements of Arkansas Code §§ 20-24-115 and 20-24-116.
