- (a) For any facility being demolished under order of a state or local government agency, issued because the facility is structurally unsound and in danger of imminent collapse, the owner or operator shall submit a written NOI to the Division of Environmental Quality by either hand delivery, postmarked by United States Postal Service, or commercial delivery service as early as possible before, but not later than one (1) working day following commencement of demolition.
- (b) Such notice shall be accompanied by the required fee which is described in Subpart 16 of this part.
Codification Notes: “NOI” means notice of intent.
