(a)

1. (1) Arkansas Rehabilitation Services will not close the case record of a referral or applicant prior to making an eligibility determination unless the applicant:

   1. (A) Declines to participate; or
   2. (B) Is unavailable to complete an assessment for determining eligibility and priority for services.
2. (2) Arkansas Rehabilitation Services will make a reasonable number of attempts to contact the applicant (at least one (1) in writing) or the applicant’s representative to encourage the applicant’s participation.
3. (3) 34 C.F.R. § 361.44.

(b) Procedures — Closed not rehabilitated before/during evaluation.

   1. (A) Complete Certificate of Eligibility/Ineligibility.
   2. (B) See Forms, Appendix E.
2. (2) The case management system will generate the status move after required data is keyed for Status 08.

3. (3) Note.

   1. (A) An annual review is required on a case that has been closed as incapable of achieving an employment outcome due to the severity of disability.
   2. (B) This review need not be conducted in situations in which the:

(i) Individual has refused;

1. (ii) Individual no longer resides in the state;

   1. (iii) Individual’s whereabouts are unknown; or

      1. (iv) Individual’s medical condition is rapidly progressive or terminal.
