1. (a) Any party who disagrees with the findings and decision of the IHO has a right to bring a civil action with respect to the determination under review.

2. (b) The action may be brought in any:

   1. (1) District court of the United States without regard to the amount in controversy; or
   2. (2) State court of competent jurisdiction.
