(a) Prior to dispensing medical marijuana to a qualified patient or designated caregiver, a dispensary agent shall:

1. (1) Verify the identity of the qualifying patient or the designated caregiver;
2. (2) Verify the validity of the qualifying patient or designated caregiver’s registry identification card;
3. (3) Enter the qualifying patient or designated caregiver’s registry identification number listed on the registry identification card into the inventory tracking system;
4. (4) Verify that the qualified patient or designated caregiver has a current authorization by the Department of Health to purchase medical marijuana;
5. (5) Verify that the amount of medical marijuana the qualifying patient or designated caregiver is requesting would not cause the qualifying patient to exceed the limit on obtaining no more than two and one-half ounces (2 1/2 oz.) of usable medical marijuana during any fourteen-day period; and

6. (6) Enter the following information into the inventory tracking system:

   1. (A) The dispensary agent’s registry identification number;
   2. (B) The dispensing organization’s registry identification number;
   3. (C) The amount, type, and strain of medical marijuana dispensed;
   4. (D) Any UIN associated with the medical marijuana;
   5. (E) Purchase price of the medical marijuana;
   6. (F) Identity of the individual to whom the medical marijuana was dispensed, whether the qualifying patient or the qualifying patient’s designated caregiver;
   7. (G) The date and time the medical marijuana was dispensed; and
   8. (H) If an order is placed for delivery, the following information shall also be recorded:

(i) Registry identification numbers for the agents assigned to deliver the medical marijuana;

1. (ii) Address for delivery;

   1. (iii) Estimated time of delivery; and

      1. (iv) Actual time of delivery.

(b)

1. (1) Dispensaries may sell medical marijuana to a visiting qualifying patient if the patient produces evidence of his or her registry identification card or its equivalent that is issued under the laws of another state, district, territory, commonwealth, or insular possession of the United States and proof of registration with the Department of Health.

2. (2) For each sale to a visiting qualifying patient, the following information shall be entered into the inventory tracking system:

   1. (A) The dispensary agent’s registry identification number;
   2. (B) The dispensing organization’s registry identification number;
   3. (C) The amount, type, and strain of medical marijuana dispensed;
   4. (D) Any UIN associated with the medical marijuana;
   5. (E) Identity of the individual to whom the medical marijuana was dispensed; and

   6. (F) The date and time the medical marijuana was dispensed.

      1. (c) A dispensary shall not use a self-service machine such as a vending machine for the purchase and dispensing of medical marijuana.
      2. (d) Use or consumption of medical marijuana on the premises of the dispensary is prohibited.
