As used in this part:

1. (1) “Accounts receivable” means the accounts receivable unit of the Division of Finance of the Department of Human Services;
2. (2) “Director” means the Director of the Division of Medical Services;
3. (3) “Division” means the Division of Medical Services of the Department of Human Services;

4. (4)

   1. (A) “Gross receipts” means gross receipts paid as compensations for services provided to residents of nursing facilities, including but not limited to client participation.
   2. (B) “Gross receipts” does not mean charitable contributions;
5. (5) “Medicaid” means the medical assistance program established by Title XIX of the Social Security Act, as existing on January 1, 2001, and administered by the Division of Medical Services;

6. (6) “Midnight census” means the count of:

   1. (A) Each patient occupying a nursing facility bed at midnight of each day;
   2. (B) Those beds placed on hold during a period of time not to exceed five (5) consecutive calendar days during which a patient is in a hospital bed; and
   3. (C) Those beds placed on hold during a period of time not to exceed fourteen (14) consecutive calendar days during which a patient is on therapeutic home leave;
7. (7) “Multiplier” means the fixed-dollar amount used to calculate the quality assurance fee;

8. (8)

   1. (A) “Nursing facilities” means any building, structure, agency, institution, or other place that requires payment for the reception, accommodation, board, care, or treatment of more than three (3) unrelated individuals who, due to a physical or mental infirmity, are unable to care for themselves.

   2. (B) Nursing facilities does not mean:

      1. (i) Offices of private physicians and surgeons;
      2. (ii) Boarding homes;
      3. (iii) Residential care facilities;
      4. (iv) Intermediate care facilities for the mentally retarded;
      5. (v) Hospitals;
      6. (vi) Institutions operated by the federal government or licensed by the Division of Developmental Disabilities Services; or
      7. (vii) Any facility which is conducted by and for those who rely exclusively upon treatment by prayer for healing in accordance with tenets or practices of any recognized religious denomination; and
9. (9) “Patient days” means the number of patients in a nursing facility as determined by the midnight census.
