- (a) Any applicant applying for registration may contact the local Office of Early Childhood office or childcare licensing specialist to obtain information and the necessary application and related forms.
(b)
- (1) A preapplication consultation meeting shall be required for all applicants for registration prior to approval of the application.
- (2) This meeting shall be offered prior to or within thirty (30) days of receipt of the application.
(c) Upon receipt of a signed application, the childcare licensing specialist shall schedule an appointment to:
- (1) Inspect;
- (2) Evaluate; and
- (3) Make a recommendation for consideration of registration to the Office of Early Childhood.
(d) The childcare licensing specialist shall make unscheduled visits throughout the year to:
- (1) Determine continued compliance of standards; and
- (2) Offer consultation and technical assistance.
(e)
- (1) The registration, as issued, shall apply only to the home’s location at the time of registration.
- (2) The registrant shall notify the childcare licensing specialist’s office of any change of location or ownership, at which time a new study shall be conducted.
- (3) Upon issuance of a registration, the registration shall remain in effect as long as compliance is maintained.
(f) New provisional registration.
- (1) If the childcare licensing specialist finds that an applicant for a registered home meets the registration requirements or has a reasonable expectation of correcting deficiencies within specified time frames, the childcare licensing specialist may recommend a new provisional registration to the Office of Early Childhood.
(2)
- (A) The new provisional registration shall be in effect for a period of time not to exceed twelve (12) months.
- (B) This time frame shall be specified in the provisional registration.
- (3) The childcare licensing specialist has sixty (60) days to submit a recommendation to the Office of Early Childhood for a provisional registration.
(g) Regular registration. The childcare licensing specialist will recommend a regular registration when:
- (1) The home has demonstrated substantial compliance; or
- (2) An existing registrant with a regular registration relocates their home and their past demonstrates a substantial level of compliance.
(h) Probationary provisional registration.
(1)
- (A) The Child Care Licensing Unit may issue a probationary provisional registration when the home is not maintaining substantial compliance due to deficiencies which are so numerous, frequent, or severe as to potentially jeopardize the health, safety, and welfare of children.
- (B) The home and the licensing unit shall have a corrective action plan in place addressing the issues.
(2) Based on the level of compliance during the period of the probationary provisional registration the licensing unit may:
- (A) Issue a regular registration;
- (B) Suspend a registration; and
- (C) Revoke a registration.
(i) Suspension or revocation of registration.
- (1) At the time of a final determination by the Office of Early Childhood of revocation or suspension of a registration, the Office of Early Childhood shall specify in the letter the period and terms of the action.
- (2) A revocation of a registration shall be set for no less than one (1) year but may be for a longer term as established by the Office of Early Childhood.
(3)
- (A) Related parties shall not be eligible to apply for registration for the same specified period.
- (B) “Related parties” means:
(i) Immediate family members;
(ii) Members of the board of directors; and
- (iii) Person or entities associated or affiliated with, or that share common ownership, control, or common board members or that have control of or is controlled by the registrant.
(C) “Immediate family member” means:
- (i) A spouse;
- (ii) Step-relationships;
- (iii) In-law relationships;
- (iv) A child;
- (v) A natural or adoptive parent;
- (vi) A sibling;
- (vii) A grandparent;
- (viii) A grandchild; or
- (ix) A son-in-law or daughter-in-law.
- (4) The revocation of a registration places that registration in a null and void status.
- (5) At the completion of the terms of revocation, homes wishing to be reregistered must submit a new application for registration for review and approval by the Office of Early Childhood.
