20 CAR § 1002-808 – Recoupment

(a) First Connections and, or, or both the lead agency for First Connections may recoup any Part C funding if it is determined that the service provider failed to comply with this part.
(b) The Division of Medical Services of the Department of Human Services may recoup any Medicaid payments made to a local provider program and, or, or both an individual service provider for any IFSP service if it is determined that the local provider program and, or, or both an individual service provider failed to comply with this part or Medicaid requirements.
