Monetary penalties

- (a) The Department of Education may impose a civil monetary penalty on a service provider, not to exceed five hundred dollars ($500), for each violation of this part.
(b)
- (1) The department may file suit to collect a civil monetary penalty assessed pursuant to this part if the service provider does not pay the civil monetary penalty within sixty (60) days from the date First Connections and, or, or both the lead agency provides written notice of the imposition of the civil monetary penalty to the manager on record for the local provider program.
- (2) The department may file suit in Pulaski County Circuit Court or the circuit court of any county in which the service provider is located.
