- (a) The Division of Provider Services and Quality Assurance may impose on an EIDT a civil monetary penalty not to exceed five hundred dollars ($500) for each violation of this part.
(b)
- (1) The division may file suit to collect a civil monetary penalty assessed pursuant to this part if the EIDT does not pay the civil monetary penalty within sixty (60) days from the date the division provides written notice to the EIDT of the imposition of the civil monetary penalty.
- (2) The division may file suit in Pulaski County Circuit Court or the circuit court of any county in which the EIDT is located.
