- (a) The Division of Developmental Disabilities Services may impose on a provider a civil monetary penalty not to exceed five hundred dollars ($500) for each violation of this part.
(b)
- (1) The division may file suit to collect a civil monetary penalty assessed pursuant to this part if the provider does not pay the civil monetary penalty within sixty (60) calendar days from the date the division provides written notice to the provider of the imposition of the civil monetary penalty.
- (2) The division may file suit in Pulaski County Circuit Court or the circuit court of any county in which the provider is located.
